End User License Agreement

1. Acceptance

This End User License Agreement (the "EULA") governs your installation and use of the Vendor mobile application (the "App"). By installing, accessing, or using the App, you agree to be bound by this EULA. If you do not agree, do not install or use the App. Vendor is owned and operated by Pamela Ferguson.

2. License Grant

Subject to your compliance with this EULA and your active subscription, you are granted a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your own legitimate business use as a trading card vendor.

3. Restrictions

You may not (a) reverse-engineer, decompile, or disassemble the App; (b) modify, adapt, translate, or create derivative works of the App; (c) scrape, mirror, or redistribute pricing data retrieved through the App; (d) share, sublicense, sell, lease, or rent the App or your account credentials to third parties; (e) attempt to bypass the App's device limits, subscription gates, or anti-abuse safeguards; or (f) use the App in violation of any applicable law or regulation.

4. Subscription and Device Limit

Use of the App requires an active subscription. Each subscription permits use on a limited number of simultaneous devices as described on our Pricing page. Devices inactive for 30 consecutive days are automatically released. Subscriptions are processed by Paddle.com as Merchant of Record; refer to the Terms of Service for billing terms.

5. Pricing Accuracy Disclaimer

IMPORTANT. Prices displayed in the App are market estimates derived from third-party data sources, including recent TCGplayer sold listings and eBay sold comparables. They are informational only and are not guarantees of value. Card market values fluctuate. You assume all risk when making purchase, sale, or trade decisions based on App pricing. Vendor is a tool to assist your pricing decisions, not a replacement for your judgment. We are not liable for any financial loss resulting from reliance on App pricing.

6. Intellectual Property

The App, including its source code, design, branding, and documentation, is the intellectual property of Vendor. All rights not expressly granted under this EULA are reserved. Vendor is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Wizards of the Coast, Bandai Namco, or any other trading card game publisher. All card names, images, and trademarks remain the property of their respective owners.

7. Data Handling

Deal data, including customer names, card valuations, and transaction details, is stored locally on your device and is never transmitted to our servers. To identify a card, the App sends the card image to our servers and returns the match; our servers also receive the authentication tokens necessary to deliver pricing. 8. Updates

We may release updates to the App from time to time. Updates may add, modify, or remove features and may be installed automatically by your device or app store. Continued use of the App after an update constitutes acceptance of the updated App.

9. Termination

This EULA remains in effect until terminated. You may terminate it at any time by uninstalling the App and cancelling your subscription. We may suspend or terminate your license if you breach this EULA or misuse the App. Upon termination, your license to use the App ends and you must uninstall the App.

10. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that pricing data will be accurate or complete.

11. Limitation of Liability

Our total liability under this EULA is limited to the amount you have paid for the App in the twelve (12) months preceding your claim. In no event shall Vendor be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if advised of the possibility of such damages.

12. Changes to this EULA

We may update this EULA from time to time. Continued use of the App after an updated EULA takes effect constitutes your acceptance of the updated terms. Material changes will be communicated in-app and via email to active subscribers.

13. Governing Law

This EULA is governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles.
