1. Agreement to Terms

By using Vendor ("the App") and related services operated at vendortcg.com, you agree to these Terms. Vendor is owned by Pamela Ferguson.

2. Service Description

Subscription-based mobile app providing real-time market pricing for trading card games (Pokémon, Magic: The Gathering, One Piece TCG) to help professional vendors make buy offers. Features include camera scanning, manual search, market pricing, deal building, and receipt generation.

3. Pricing Accuracy Disclaimer

IMPORTANT. Prices displayed in the App are market estimates based on recent TCGPlayer sold listings. They are provided for informational purposes only and are not guarantees of value. Market prices for trading cards fluctuate frequently. You assume all risk when making purchase, sale, or trade decisions based on pricing displayed in the App. Vendor is a tool to assist your pricing decisions, not a replacement for your judgment. We are not responsible for any financial loss resulting from reliance on App pricing.

4. Subscriptions and Billing

Vendor subscriptions are available at $20 per month or $200 per year. All purchases are processed by Paddle.com as Merchant of Record. Paddle handles billing, tax collection, and payment processing. By subscribing, you agree to Paddle's Buyer Terms. You may cancel your subscription at any time; your subscription remains active through the end of your current billing period.

5. Device Limit

Each subscription permits use on 2 simultaneous devices. Devices inactive for 30 consecutive days are automatically freed and available for reassignment. If you exceed the device limit, you must wait for an inactive device to expire or contact support to manually free a device.

6. Acceptable Use

You agree to use the App for legitimate business purposes. You may not: reverse-engineer or decompile the App; scrape pricing data for resale or redistribution; share your API key with third parties; attempt to bypass device limits; or violate any applicable laws or regulations. We reserve the right to terminate accounts that violate these terms.

7. Intellectual Property

Vendor is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Wizards of the Coast, Bandai Namco, or any trading card game publisher. All card names, images, and trademarks belong to their respective owners. Vendor is a third-party tool that references publicly available market data and does not claim ownership of card intellectual property.

8. Data Handling

All deal data (including customer information, card valuations, and transaction details) is stored exclusively on your device and is never transmitted to our servers. Our servers receive card identification queries for pricing retrieval and your API key for authentication. See our Privacy Policy for complete details.

9. Service Availability

Pricing functionality requires an active internet connection and depends on third-party data providers. Service may be interrupted, suspended, or degraded due to maintenance, updates, or technical issues. The App includes a manual price entry fallback for offline use. We do not guarantee uninterrupted uptime or availability.

10. Limitation of Liability

Our total liability under these Terms is limited to the amount you have paid in the 12 months preceding your claim. In no event shall Vendor be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. Your continued use of the App after such changes constitutes your acceptance of the revised Terms. Material changes will be communicated to all active subscribers via email.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles.
